Copyright Lawsuit Against Rapper Lil Jon Dismissed From Court

A copyright lawsuit against rapper/producer Lil Jon and TVT Records has been dismissed from the US Distruct Court for the Northern District of Georgia, HipHopsHome.com has learned.

A freelance musician named Redwin Wilchcombe had claimed that he and his manager, who were part of a production team called Red Teamwerk, were at least partially responsible for coming up with the hook to Lil Jon’s song “Weedman.”

Wilchcombe claimed that the idea for the song came about in a recording studio after someone suggested that they should call a dealer to get a supply of marijuana. Wilchcombe allegedly then came up with a chorus and performed it for Lil Jon who claimed he liked the words.

It is claimed that Lil Jon later used the vocals on his track entitled “Weedman” which appeared on his double platinum selling album “Kingz Of Crunk.”

Wilchcombe decided to sue Lil Jon and TVT Records after not being paid for his contributions to the song. He admitted that he did not have and had never discussed a contract or payment for the use of the chorus.

“The district court correctly found that the parties’ conduct created an implied license,“ ruled Chief Judge Robert L. Hinkle. “Wilchcombe does not dispute that he created the song for the album at Lil Jon’s request and that he instructed Taylor to send it to Lil Jon for final mixing and inclusion on the album. Wilchcombe testified in his deposition that he understood Lil Jon would use the song on the album. In addition, Wilchcombe does not dispute that when he handed over the song, he never discussed with Taylor or any of the Appellees that using the song would constitute copyright infringement.”

Because of the lack of a written contract that supported Whilchcombe’s claims the court made the decision to dismiss his appeal.

“The district court properly rejected these arguments for this reason, and we likewise refuse to give Wilchcombe a ‘second bite at the apple.’”
